Terms of Delivery:
Sygsoft Holland aims to raise awareness of the rich cultural and historical heritage of church organs and other keyboard instruments in the Netherlands, and to preserve their sound characteristics for the future.
With this goal in mind, Sygsoft Holland records the sounds of an instrument and compiles a so-called sample set, which is offered for sale via the website www.hauptwerk.nl.
This sample set is the intellectual property of, and recorded and developed by, Sygsoft Holland, C.C.A. Boogaard (licensor).
The subject of the agreement is the sample set.
The licensor grants you (the licensee) the right to use the sample set under the following conditions:
1.
The licensor grants the licensee the use of the sample set for an indefinite period.
2.
The licensee is not entitled to:
a. Copy, reproduce, rent, re-sample, trade, resell, or further develop the sample set for any other form of distribution.
b. Remove or modify the codes or keys that secure and identify the sample set.
c. Transfer the sample set or grant sub-licenses to third parties.
d. Integrate the sample set wholly or partially into another database.
e. Use the sample set for public presentation or sound reproduction without special permission.
The licensor reserves all rights regarding the sample set.
3.
The licensee possesses the basic knowledge regarding the operation of the sample set, the computer, and other necessary matters to ensure proper functioning.
4.
The licensee pays the licensor a one-time, non-refundable fee in accordance with the price applicable at the time of order. The sample set will be delivered within approximately 5 working days after payment is received, if possible.
5.
The legal relationship between the licensor and licensee is governed by Dutch law.
6.
Privacy protection of the licensee:
The licensee’s information, such as name, address, city, and email address, will never be shared with third parties without the express consent of the licensee.
